New Overtime for Casuals from 1 January 2018
The FWC decision allows for overtime provisions for casual employees. Commencing from the first full pay period on or after 1 January 2018 overtime will need to be paid to casual employees when they work in excess of:
• 12 hours per day or per shift, and/or
• 38 hours per week or where the casual employee works in accordance with a roster,
an average of 38 hours per week over the roster cycle (which may not exceed 4 weeks)
(e.g. 76 hours for a fortnightly roster, 152 hours for a 4-weekly roster)
When determining whether or not an employee has worked in excess of 12 hours per day/shift meal breaks (paid and unpaid) are excluded. The time the employee actually performs work is what must equate to more than 12 hours in order for overtime to be applicable.
Members should also note that when determining whether an employee has worked in excess of 38 hours per week, any hours already paid at overtime should not be included. (i.e. Overtime worked on any day stands alone).
